CONTENT OVERVIEW

commercial Update:

Commercial Property has undergone major changes within the last 2 years.  In particular, the last year has seen some very important case law and regulatory changes.  The course aims to look at these changes. Topics covered include:

  • recent commercial lease case law including break clauses, dilapidations and the Landlord and Tenant Act 1954
  • Legionnaires’ Disease Report
  • recent Village Green case law
  • leasehold minimum energy performance standard as of 2018
  • The Electronic Communications Code 2017
  • recent case law
  • new 2018 CPSE Enquiries
  • recent case law on business rates and empty properties

Utilities:

Utilities are being procured by conveyancers pre exchange of contracts more frequently, in order to:

  • ensure no Utility rights exist where agreements have not been or are not deposited with the title deeds
  • give buyers visibility of their connection options
  • give buyers a picture of the utility remediation challenge on site
  • give buyers a picture of any off site constraints
  • give their designers early visibility of the utility challenge with the changes in the CDM regs and guidance on the subject
  • allow the buyers valuer to adjust the residual value in the event of the need for utility remediation.

Utility information is fast becoming part of a standard search pack for Conveyancers. No longer is utility information considered unobtainable in a sensible timeframe, cost or thought to be a task left to the post legal transaction development lifecycle. Jeremy will be developing all of these themes in his presentation.
